In enrolling as a Bodhi Yoga™ Annual Monthly Unlimited Member I expressly agree to honor the following contract terms 1-7:
(1) My Bodhi Yoga™ Unlimited Yoga Membership is a twelve (12) month commitment, after which my membership will automatically renew for the following twelve months at the current Bodhi Yoga™ Annual Membership rate, determined by Bodhi Yoga™. I acknowledge that the amount may vary from my current Bodhi Yoga™ Annual Membership Contract, which includes all regular weekly Yoga and Nia classes. In addition, my Bodhi Yoga™ Membership will include FREE access to the On-line Bodhi Yoga™Center, available as soon as Fall 2011. I understand that this contract doesn’t include any specialty classes, workshops or Bodhi Yoga™ training.
(2) I understand that failure on my part to regularly utilize the Bodhi Yoga™ facility does not relieve me of my monthly obligation, regardless of the circumstances, to pay this contract/promissory note in full. I understand that my membership is non-cancelable. Should I default, I agree to pay all costs of collection, including but not limited to collection agency fees, court cost, and reasonable attorneys fees, all of which may be paid or incurred by Bodhi Yoga™. Bodhi Yoga™ Auto-membership payments which are not honored by members credit/debit cards will asses a $25. auto-return check fee. This will be the sole liability of responsibility of Bodhi Yoga™ Annual Member
(3) As a Bodhi Yoga™ member, I may freeze my Annual membership for one (1) month out of every year, the first time being six (6) months after membership commencement date. During this time I will not be able to attend classes without payment. This option will only be honored by Bodhi Yoga™ when requested by member with 15 days prior notice by e-mail or in writing.
(4) As a Bodhi Yoga™ Annual Member, I am required to enroll for a minimum of twelve (12) months, after which the membership will continue to auto renew, following the initial twelve (12) month term, until I inform Bodhi Yoga™ of the desire to cancel my membership. I fully agree that cancellation must be in writing, received by Bodhi Yoga™, 30 days prior to next billing date, (for example if I, as a semi-annual member, fulfilled my initial 6-month contractual commitment to Bodhi Yoga™ and I wished to cancel my auto-debit on February 14th, I would need to notify Bodhi Yoga™ IN WRITING by January 14th). These auto-debits will be drawn from my credit/debit card used at the time of Bodhi Yoga™ membership purchase. Member authorizes monthly auto-debits from their initial credit/debit card used to complete first months purchase until cancellation set fourth herewith.
(5) For cancellation: I must notify Bodhi Yoga™ at least 30 days prior to next auto draft in writing with member's signature. Bodhi Yoga™ does not accept phone, verbal, e-mail or voice mail cancellations. In turn, Bodhi Yoga™ will send a confirmation via email after the changes have been made to my membership.
(6) All rates and fees are final upon membership commencement date of electronic signature/authorization, and agreement of membership, unless there is a failure to meet the requirements listed above, for which I agree to all said terms and conditions. Further, in the event of non-payment, I agree to pay collection, judgment and/or legal expenses incurred by Bodhi Yoga™ in effort to redeem all aspects of member's contract.
Authorization Agreement: Enrolling above, I authorize Bodhi Yoga™ to automatically debit my above Debit/Credit card monthly for twelve (12) months at the current Annual Contract rate and in full agreement of the above contract, which will automatically renew under the afore mentioned terms of the contract. I understand that by participating in yoga practice I/my child is assuming a known risk. Receiving instruction & participation is at my own discretion and I am not required to attempt any yoga or movement posture, acu-pressure, aromatherapy or breath-work.
I understand that a physician consultation is recommended prior to beginning any new type of physical exercise. I agree to hold the instructor, White Mountain Yoga/Thai Yoga Therapy L.L.C dba Bodhi Yoga™, harmless for any injury resulting from any aspect of this class, be it instruction, equipment failure, or participation on my part, or my own yoga practice. I further give the yoga instructor permission to give “hands on adjustments" to my yoga postures, I understand that this is done to correct misalignment and improve my yoga experience. If I am uncomfortable with any touch I understand it is incumbent upon me to notify said instructor prior to class that I choose not to be touched. I understand that the yoga instructor is not an LMT.
I understand that due to time & space reservation, all tuition(s), enrollment, collection costs are non-transferable/non-refundable. I acknowledge by enrolling above, that I have been notified that I have a three (3) day right of rescission on the contract enrollment from the enrollment date , should I choose not to participate in Bodhi Yoga™ Classes. I understand that should I not continue, I will pay the drop-in rate of $10 for each yoga class I attended in the interim three (3) day period.
I have been notified that all equipment or services are subject to deletion or change at the discretion of Bodhi Yoga™. IN THE EVENT THAT BODHI YOGA™ CLOSES AND ANOTHER YOGA FACILITY OPERATED BY THE SELLER, OR ASSIGNS OF THE SELLER, OF THIS CONTRACT IS NOT AVAILABLE WITHIN A FIVE (5) MILE RADIUS OF THE LOCATION THE MEMBER INTENDS TO PATRONIZE, SELLER WILL REFUND TO MEMBER A PRO-RATA SHARE OF THE MEMBERSHIP COST BASED UPON THE UNUSED MEMBERSHIP TIME REMAINING ACCORDING TO THE CONTRACT.
